Medical History – Why It Matters in a Personal Injury Case
When we initially take a Georgia personal injury case, we get a thorough medical history from our client. After getting this history, we then request all the prior medical records. Often times, a client will ask us “Why do you need all this information?” There are several reasons.
- If we file a lawsuit in your case, the other side will request information about your medical treatment before your injury. They do that to see if you have any pre-existing conditions or similar injuries in the past. I need that information, not only in case we file suit, but to help me value your case and give you advice about it before we ever make a settlement demand. That’s because the value of your case is whatever a jury is likely to say if we try it.
- If you have had a similar injury or treatment to the area of your body that was injured in the case we’re handling for you, I may want to talk to your doctor about whether that prior injury or treatment affected the injury in your case. When I talk to your doctor I want to be able to show them the prior records so they can give me a well informed opinion. If the doctor does not have all the information, the insurance company or their attorney will try to use it to attack the doctor’s opinion and hurt the value of your case.
- One other reason that we get your medical information from the very beginning is because it is often hard to remember everything. I think it’s fair to say that anyone who has to give a list of every doctor who ever treated them is bound to forget one or two. By getting your records early on, we can go through them and usually find out about any doctors that you may have forgotten. This way, we make sure that we have a complete list if we need to file suit.
Not all lawyers get this detailed medical history from their clients. It may take some time on our part, but we believe that time is worth it in order for us to do the best job we can for you.
