Does it Help if my Personal Injury Attorney is Local?

Hey, this is Ann Margaret Perkins with Perkins Law Firm and today I’m going to be answering the question: Does it help if your personal injury attorney is local? And the short answer is, all other things being equal, yes.
Think about it like having a local doctor. There’s less travel involved to get to their office. If you have an out of town attorney or doctor, it’s very unlikely that they’re going to travel to you; so when you want to see them, you’re going to have to travel farther. That’s time out of your life. It also may be at a time when traveling for you is difficult. Spending less time in the car going somewhere may make a big difference in how you feel.
It may be with a local attorney you’re in PTO together; your kids play rec ball together, or you go to church together. Maybe not, but odds are, if you don’t know that attorney, someone in your local community does, and that can only help in terms of the kind of attention you get from that attorney (or doctor).
Finally, reputation matters to people who are local. If I’m not responsive to you, I know that may affect my business in the future. You may say something to your neighbor and that may impact other people’s decisions about whether or not to hire me. I have an incentive to do a good job for you because you are, to some degree, my neighbor. What you say to our neighbors about me matters to me.
I said at the beginning of this podcast “all other things being equal” I think it’s better to have a local personal injury attorney. You also need an attorney who is experienced. You don’t want a surgeon who has only done 3 surgeries doing surgery on you. You want someone who has done your kind of surgery every day over a long period of time, and you want the same thing from a personal injury attorney – someone who has both length of experience and depth of experience in handling your kind of case. You want someone who has tried and will try cases. Insurance companies know attorneys who will and will not try cases. They pay less money in settlement to attorneys they know don’t try cases. If you do end up having to go to court, you want to have your attorney be familiar with going to court and be someone you know can handle that case effectively for you in a courtroom. You want an attorney that you’re comfortable with. It’s a close relationship and it can last a while. So you need to make sure that you feel good about that person and that you communicate effectively with her.
If you’ve got someone with experience in terms of personal injury, someone who is experienced in terms of trying cases and someone that you’re comfortable with, and that person is local, then I think you have the best of everything.
I want to briefly mention how you might go about determining if an attorney is experienced and tries cases. Don’t just look at what an attorney says about himself on his website or in advertisements. You want to know what others say about him. Many times with a local attorney you can find someone who has used that attorney. Get feedback from them on their experience. Look at the attorney’s website to see what he says about his experience and what clients that are quoted on the website say, but don’t stop there. Look at what organizations he is involved in, the length of time he’s been practicing and the results that he has gotten. But a word of caution there too. You shouldn’t think that any prior result an attorney has gotten means that you are going to get an equivalent result. A great result in one case doesn’t guarantee future results. Every case turns on its own facts. So do your homework before you hire any attorney (or doctor) for that matter.
